Temporary Skill Shortage (TSS) Visa Subclass 482

The Temporary Skill Shortage (TSS) Visa, also known as the subclass 482 visa, is a work visa that allows Australian employers to fill skill shortages by bringing in skilled workers from worldwide. This visa allows foreign workers to live and work in Australia temporarily. There are different streams under this visa, including the short-term, medium-term, and labour agreement streams. Each stream has its own requirements and benefits.

There are three main streams under this visa:

About the Visa

The 482 visa allows skilled workers from other countries to work in Australia for an approved sponsor in specific occupations. The sponsor must be an approved Australian business. The worker must have the required skills and work experience for the job.The length of stay depends on the stream under which the visa is granted. In general, it can range from 2 to 4 years.

There are three main streams of the TSS 482 visa:

This visa can also lead to Permanent Residency (PR) for some applicants through the TSS visa pathways to PR.

Short-term Stream

This visa lets you work in Australia for 2 years. Some specific jobs that fall under international trade rules can work for 4 years instead.

Key points:

  • Your occupation should be on the Short-term Skilled Occupation List (STSOL)
  • You must meet English language requirements, usually an IELTS score of 5.0 overall with no band less than 4.5.
  • You cannot apply for permanent residency directly through this stream.
  • You can renew the visa once while inside Australia

Medium-term Stream

This stream is for occupations on the Medium and Long-term Strategic Skills List (MLTSSL).

Key points:

  • The visa can be permitted for up to 4 years.
  • You can apply for Permanent Residency (PR) after 3 years of working with the same sponsor.
  • Higher English requirements: IELTS score of at least 5.0 in each band.
  • This is also known as the 482 long term visa.

Labour Agreement Stream

This stream is for skilled workers nominated by employers who have a labour agreement with the Australian Government.

Key points:

  • This is set up for certain businesses or areas that are short on skilled workers.
  • The employer and the government have agreed on what’s needed.
  • May include occupations not listed on STSOL or MLTSSL.
  • May offer different pathways to PR depending on the agreement.

Eligibility Criteria for the Applicant

To get the 482 visa, you need to meet particular requirements.

  • Be nominated by an approved sponsor.
  • Have the skills and qualifications required for the job.
  • Have at least 2 years of relevant work experience.
  • Meet English language requirements.
  • Meet health and character requirements.

Approved Sponsor

An approved sponsor is an Australian business or organization that has permission from the government to hire overseas workers. Employers must:

  • Be a lawfully operating business in Australia.
  • Apply for standard business sponsorship (SBS) approval.
  • Nominate the foreign worker for a specific occupation
  • Pay fees and charges, such as the Skilling Australians Fund (SAF) levy.
  • Offer terms and conditions that are equivalent to what an Australian worker would receive.

Qualifications for the Employerโ€™s Nominated Occupation

The occupation must:

  1. Be on the relevant skilled occupation list (STSOL or MLTSSL).
  2. Match your work experience and qualifications.
  3. Have a market salary rate that meets the required Salary Level 482 Visa guidelines.

Employers must also ensure that the job is listed on the correct skilled occupation list.

Salary Level 482 Visa

For those applying for a 482 visa, the salary offered is a critical component of the application. Employers sponsoring overseas workers must ensure they meet specific remuneration standards. Firstly, the annual income must be no less than the Temporary Skilled Migration Income Threshold (TSMIT). The old salary rule was AUD $70,000 per year. Just know that this number can change. It increased to AUD $73,150 starting July 1, 2024, and it’s set to go up even more to AUD $76,515 from July 1, 2025.

Besides the minimum, the salary offered must also range with the prevailing market rate for that particular job in Australia. This means the pay should be comparable to what an Australian employee with similar skills and experience would earn in the same role. Additionally, the benefits and working conditions provided to the overseas worker must be similar to those offered to Australian citizens or permanent residents. These complete salary requirements are in place to shelter overseas workers, ensuring they receive fair compensation and are not subjected to underpayment or exploitation, thereby protecting the integrity of the Australian labour market.

  • Exemptions may apply for citizens of English-speaking countries or those with certain education levels in English.

Including Family Members in Your Application

When you apply for your 482 visa, you don’t have to go it alone. You can include your partner and any dependent children right on your application. This means your whole family can work and study in Australia, enjoying the same opportunities as you. It makes moving to Australia a much smoother experience for everyone!
